Terms of Service

Simmerlo · Effective October 19, 2026

These terms govern your use of Simmerlo. By creating an account or using the app, you agree to them. If you do not agree, do not use the app.

1. Who we are

Simmerlo is published by Dalian Zhiliaoshengsheng Culture Communication Co., Ltd., a limited liability company registered in Wafangdian, Dalian, China. Notices under these terms, and any question about them, go to [email protected].

2. The service

Simmerlo estimates the calorie and macronutrient content of a meal from a photo you take, stores the entries you choose to save, and syncs them across your devices when you are signed in. The app also lets you log meals manually and set a personal daily calorie target.

3. Accounts

4. Acceptable use

5. Subscriptions and billing

Premium is an auto-renewing subscription. It is billed through the app store you purchased it from — Apple App Store on iOS or Google Play on Android — and the store's payment terms, pricing and refund policies apply to the transaction. We never see or store your payment card details.

6. Estimates are not guaranteed

Every calorie and macronutrient figure the app produces is an estimate generated by a vision model from a single photo. Oil, sauces, hidden ingredients, portion depth and lighting all make the true value uncertain. Estimates are provided for general informational tracking only, without any warranty of accuracy, and you should treat the range, not a single number, as the result.

Nothing in the app is medical advice, diagnosis or treatment. Do not use it to manage a medical condition. See the Health disclaimer in our Privacy Policy and in the app.

7. Your content

Your meal entries, photos and profile settings remain yours. By submitting a photo for analysis you grant us only the limited technical permission needed to process it — to transmit it to a vision model and return an estimate. That permission ends when the request completes; the photo itself is not stored on our servers. You can delete everything at any time; see Delete your account.

8. Our content and trademarks

The app's name, interface, design and code are protected by intellectual property laws. You may not copy, modify or distribute them beyond what your device's operating system and the app stores' license terms allow. "Simmerlo" and the app icon are trademarks of the publisher.

9. Availability and changes

We aim to keep the service available, but we may change, suspend or discontinue any part of it. If we discontinue the service entirely, we will give reasonable advance notice in the app and by email where possible, and your stored data will remain exportable for at least 90 days after the notice. Free-tier quotas and model providers may change as the service evolves.

10. Suspension and termination

You can stop using the service at any time, and delete your account as described in the account deletion page. We may suspend or terminate an account that violates these terms — for example, sustained automated abuse of the recognition endpoint — after, where practical, a warning by email.

11. Disclaimers and limitation of liability

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranty of merchantability or fitness for a particular purpose, except where such warranties cannot be excluded by law.

To the maximum extent permitted by law, the publisher's total liability arising out of or relating to the service is limited to the greater of the amount you paid for the service in the 12 months before the claim, or USD 50. We are not liable for indirect, incidental, special or consequential damages, including the consequences of relying on an inaccurate calorie estimate. Nothing in these terms limits liability that cannot be limited by law.

12. Consumer protections

If mandatory consumer protection law in your country of residence gives you rights that these terms do not reflect, those rights prevail over anything said here. Nothing in these terms takes away statutory rights you hold as a consumer.

13. Governing law

These terms are governed by the laws of the People’s Republic of China, without regard to its conflict-of-law rules. Disputes will be handled in the courts of that jurisdiction, except where local law gives you the right to bring a claim where you live.

14. Changes to these terms

If we change these terms in a way that materially reduces your rights, we will announce the change in the app before it takes effect and update the effective date above. Continuing to use the service after a change takes effect means you accept the updated terms.
